Pursuant to Section 80 of the Sale and Supply of Alcohol Act (the Act), the Whanganui District Council hereby gives public notice that a provisional Local Alcohol Policy (LAP) was adopted on 4 July 2017 and is now subject to appeal. An appeal can only be made to the Alcohol Regulatory and Licensing Authority (ARLA) by 5 August 2017 by sending it to:

Only persons or organisations who submitted on the draft Local Alcohol Policy can appeal against an element of the provisional LAP (except for the Police and the Medical Officer of Health who can appeal regardless). The only ground on which an element of the provisional LAP can be appealed against is that it is unreasonable in the light of the object of the Sale and Supply of Alcohol Act 2012.
An appeal made under Section 81 of the Act must be made in accordance with Section 18 of the Sale and Supply of Alcohol Regulations 2013.
