The Council is seeking feedback on the review of the Alcohol Control Bylaw 2016. The Council is proposing to introduce the ability to have temporary alcohol bans for events and to retain the following existing permanent alcohol ban areas:

  • Town Centre Area - 24hrs 7 days a week
  • Kowhai Park - 9pm to 7am the following day
  • Victoria Park North - 24hrs 7 days a week
  • Victoria Park South - 9pm to 7am the following day
  • Kai Iwi Beach Area - Annually from 3pm on December 31 until 3am on January 1

Options

Amend the Alcohol Control Bylaw 2016 (preferred option)

Under this option Council would amend the Alcohol Control Bylaw 2016.

Advantages Disadvantages
  • A regulatory approach to managing alcohol within public spaces enables police to take a graduated response to the possession or consumption of alcohol to avoid crime or disorder exacerbated by alcohol.
  • The amendments to the drafting of the bylaw follow best practice and will increase the clarity of the usability of the bylaw.
  • None

Retain the Alcohol Control Bylaw 2016 (status-quo)

Under this option Council would retain the existing Alcohol Control Bylaw 2016.

  • A regulatory approach to managing alcohol within public spaces enables police to take a graduated response to the possession or consumption of alcohol to avoid crime or disorder exacerbated by alcohol. 
  • The existing bylaw does not follow best practice for the drafting of legislation.
  • The clarity of the drafting of the existing bylaw can be improved.

Revoke the Alcohol Control Bylaw 2016

Under this option Council would revoke the Alcohol Control Bylaw 2016.

  • None
  • The absence of alcohol controls within public spaces does not allow police to take a graduated response to the possession or consumption of alcohol to avoid crime or disorder exacerbated by alcohol.
