Plan Change 47 - Land stability assessment areas (stage 3) Mowhanau & Roberts Avenue / Paterson Street

Council commissioned Opus Consultants Ltd to complete a series of desktop assessments of the potential risk for land stability hazards in a range of locations.

The report for the Mowhanau and Roberts Avenue / Paterson Street (PDF, 1MB)areas was completed in July 2015.

This Plan Change incorporated sites in the Mowhanau and Roberts Avenue / Paterson Street areas that were confirmed to be moderately or highly likely to be susceptible to land instability hazards, into the Land Stability Assessment Areas (LSAA) overlay on the District Planning maps; to ensure appropriate assessment and regulation of any development on those sites and to protect the property and surrounding area. 

Decision

Plan Change 47 was made operative on Monday 5 September 2016.
Decisions on submissions were notified on Saturday 23 April 2016 and the Plan was amended effective 26 April 2016. The period for lodging appeals closed on 10 June 2016.

Plan Change 45 - Natural environment

Since the operative District Plan was drafted in the 1990s, there have been significant changes to how the natural environment of Whanganui is managed. Indigenous forestry is now managed by central and regional government. The ecology values of riparian margins are managed by Horizons Regional Council and the land adjoining the Whanganui River in the urban area has been developed into a national cycle trail.

Plan Change 45 updated the Natural Environment chapter of the Plan. It reviewed the current provisions relating to indigenous forestry, riparian margins and the river margin landscape conservation overlay. A number of the proposed changes were required to give effect to the Horizons Regional Council One Plan.

Plan Change 44 – Network utilities, parking, loading & vehicle crossings

Since the operative District Plan was drafted in the 1990s, there have been significant changes to society in terms of utilities and onsite transport infrastructure and what are acceptable effects from those activities. Network utilities have evolved to encourage more renewable energy sources and parking now focuses on a range of vehicles including bicycles and mobility parks.

Plan Change 44 updated the network utility, parking and vehicle crossing provisions based on best practice and public feedback. A clarification of the objectives, policies, rules and methods was also considered as part of this Plan Change.

Plan Change 43 – District wide

Since the operative District Plan was drafted in the 1990s, there have been significant changes to society in terms of acceptable environmental effects. This Plan Change covers a group of small activities that can occur across the District. They are verandahs, relocated buildings, temporary military training activities, earthworks and beekeeping.

Plan Change 43 updated the district-wide provisions based on feedback received and case law.  A clarification of the objectives, policies, rules and methods were also considered as part of this Plan Change.

Plan Change 42 – Signage

Signage is an essential part of many activities. However there is the potential through inappropriate size and location for signage to cause adverse effects on traffic safety and local amenity. A review of the signage provisions was undertaken in conjunction with the development of a Signage Bylaw. The Signage Bylaw came in to force on 12 October 2015.

Plan Change 42 was made operative on 21 November 2016.

Plan Change 41 – Noise

Noise is defined as unwanted sound affecting people and their perceptions of the environment, particularly in urban areas where it affects a significant portion of the population. Within rural areas fewer people may be affected, but the generally lower ambient sound levels found there can mean normally acceptable levels of sound are perceived as more intrusive.

Plan Change 41 updated the noise and vibration measurements in accordance with best practice and recommendations provided by Malcolm Hunt Associates. A clarification of the objectives, policies, rules and methods was also completed as part of this Plan change.

Plan Change 41 was made part operative (excluding Performance Standard 17.5.2) on 5 September 2016 and fully operative on Monday 21 November 2016.
Decisions on submissions were notified on Saturday 23 April 2016 and the Plan amended effective 26 April 2016. The period for lodging appeals closed on 10 June 2016.

Plan Change 40 – Financial contributions

Financial contributions provide developers and Council an opportunity to consider alternative measures to remedy or mitigate the adverse effects of land use change or subdivision. Financial contributions can be in the form of cash, land or works. The purpose is to provide an alternative approach to remedying or mitigating the adverse effects of an activity. 

Plan Change 40 updated the financial contributions section to be consistent with the Local Government Act amendments by identifying the types of effects that financial contributions may be used to mitigate.
